Five probationers serve week in jail for violations, Carter hears 16 other cases during Oct. 5 Law Day

Circuit Judge Craig Carter processed five civil cases and 21 criminal cases during the Oct. 5 session of Ozark County Law Day. Information on the criminal cases are listed below:

 

Did not appear

Dewayne R. Allen, who pleaded guilty to unlawful possession of a firearm (dangerous felon) in July, did not appear for a scheduled probation violation hearing. A “show cause” hearing, allowing the defendant to explain why he didn’t come to court, is scheduled for Nov. 9. 

 

Upcoming jury trial

Brian Dunaway, charged with murder, unlawful use of a weapon (possessing weapon and felony-level controlled substance), possession of a controlled substance, two counts of endangering the welfare of a child and two counts of assault, appeared for a pre-trial conference with his attorney Lauren Kate Welborn. He’s scheduled for a Nov. 1-3 jury trial. 

Noel D. Cole, charged with assault, endangering the welfare of a child, resisting arrest by fleeing, resisting arrest for a felony, harassment and trespassing in one case and resisting arrest in another case, appeared for a pre-trial conference. The public defender’s motion to withdraw from the case was sustained. The jury trial was continued to Dec. 21. He was remanded to the custody of the sheriff’s office. 

 

Probation violators 

serve shock jail term

Corbin Anderson, who pleaded guilty to possession of a controlled substance in March 2018, appeared for a probation violation hearing. On Sept. 19, the judge ordered that he spend 7 days in the Ozark County Jail for the violation. He was arrested Sept. 27 to serve that jail term, and he was continued on probation. 

Michael Scott Strickland, who pleaded guilty to burglary by Alford plea in May, appeared for a probation violation hearing. On Sept. 19, the judge ordered that he spend 7 days in the Ozark County Jail for the violation. He was arrested Sept. 22 to serve that jail term, and he was continued on probation. 

Patricia Sue Brown, who pleaded guilty to five counts of stealing a motor vehicle in June 2019, appeared for a probation violation hearing. On Sept. 19,the judge ordered that she spend 7 days in the Ozark County Jail for the violation. She was arrested Sept. 20 to serve that jail term, and she was continued on probation. 

Danial Teconchuk, who pleaded guilty to property damage, burglary, stealing ($750 or more), possession of a controlled substance, in October 2019, appeared for a probation violation hearing. On Sept. 19, the judge ordered that he spend 7 days in the Ozark County Jail for the violation. He was arrested Sept. 21 to serve that jail term, and she was continued on probation. The online record notes that he has new charges pending. 

Kenneth R. Cowart, who pleaded guilty to unlawful use of a weapon (exhibiting) in March, appeared for a probation violation hearing. On Sept. 19, the judge ordered that he spend 7 days in the Ozark County Jail for the violation. He was arrested Sept. 22 to serve that jail term, and he was continued on probation. 

 

Hearing continued to Oct. 19

Zack L. Burris, who pleaded guilty to domestic assault in November 2019, was scheduled to appear for a probation violation hearing. He filed a motion for continuance, which was sustained. He is scheduled to return for a probation violation hearing on Oct. 19. He was remanded to the custody of the sheriff’s office pending the hearing. 

Curtis J. Gray, charged with possession of a controlled substance in August 2021, appeared for a probation violation hearing. The court found that his due process rights are imperiled, and the public defender was appointed. The hearing was continued to Oct. 19. He was remanded to the custody of the sheriff’s office pending the hearing. 

Kenny Maynard, charged with sexual abuse and child molestation in a Taney County case that was transferred to Ozark County on a change of venue motion, was arraigned. A plea hearing or trial setting is scheduled for Oct. 19.  

Jody Weyrauch, charged with kidnapping, three counts of domestic assault, three counts of armed criminal action, robbery, tampering with a victim in a felony prosecution and two counts of possession of a controlled substance, was arraigned. A plea hearing or trial setting is scheduled. 

 

Hearing continued to Nov. 9

Timothy K. Sprague, charged with murder and unlawful possession of a firearm in one case and unlawful possession of a firearm and possession of a controlled substance in another case, appeared with his attorney for a plea hearing or trial setting. It was continued to Nov. 9 for a trial setting. 

Brandon Cowan, charged with three counts of unlawful possession of a firearm (dangerous felon), had his plea hearing or trial setting continued to Nov. 9. 

Dakota Maynard, charged promoting child pornography to a minor and possession of child pornography, appeared for a hearing. It was continued to Nov. 9. 

 

Hearing continued to Dec. 7

Sarah C. Adams, charged with two counts of domestic assault, two counts of abuse or neglect of a child (causing serious emotional or serious injury), unlawful use of a weapon (exhibiting) and three counts of endangering the welfare of a child, appeared for a plea hearing or trial setting. The judge removed the condition of house arrest from her pre-trial release. Last month he removed the condition of an ankle monitor. She is being monitored by Court Probationary Services. She is scheduled to return for a plea hearing or trial setting at 9 a.m. Dec. 7. 

Charles David Cole, charged with three counts of assault, stalking, making a terroristic threat and property damage, was arraigned. A plea hearing or trial setting is scheduled for 9 a.m. Dec. 7.
