Man reportedly defies ex-parte, threatens woman with pistol and resists arrest

Danny Batesel is being held in the Ozark County Jail without bond in connection with an incident Sunday, July 24, in which he reportedly  defied a court ex-parte order that forbid him to be at a woman’s residence, went to the home, pointed a gun at the woman and said he was going to kill her. 

He then reportedly evaded officers once they arrived on scene, resisted arrest while having a loaded revolver in his possession.

According to the probable cause statement prepared by Ozark County Deputy Josh Sherman, at 7:30 a.m. July 24, the Ozark County dispatch office received a all from a woman who said Batesel was waiving a gun near her camper and pointing it at the camper while she was inside. 

The woman told the dispatcher that a court order indicated that Batesel was not allowed to live on the property, and a full ex-parte order of protection had been filed against him in connection with the woman. 

Once deputies arrived on scene, they located the woman and had her get into a marked, assigned patrol vehicle, which they moved to a safer location to further gather details of the incident. 

“She confirmed the male suspect as Danny Batesel and indicated that he may still be armed with a 22-caliber ‘brown-ish’ pistol,” the report says. 

The woman said she felt alarmed and threatened and didn’t feel safe having Batesel near if deputies couldn’t find him. 

Officers looked for Batesel on scene unsuccessful, and they believed he was intentionally evading them. After failed attempts to find the suspect and make contact, Sherman, Deputy Matt Rhoades and Cpl. Seth Miller entered the home and found Batesel in a bedroom. 

Officers told Batesel to exit a bedroom he was in with the door closed. After several commands, Batesel opened the door and walked toward deputies - then started to retreat back into the room. The deputies followed him into the bedroom, and Batesel was assisted to the floor where he was placed in handcuffs. 

Once in restraints, officers searched the bedroom and found a loaded .22 caliber revolver with a wooden grip located a few feet from where he was placed in cuffs. 

Officers confirmed that there was a full ex-parte order of protection against Batesel issued on May 11, notifying him that he was not allowed to reside at the home or communicate with the woman, commit acts of violence toward her or threaten acts of violence toward her. 

The woman showed officers a text messages Batesel had sent that day prior to officers arrival and again prior to him being placed in handcuffs. 

Information on his arraignment has not yet been issued, according to online court records.
