35 cases heard during November 8 Law Day

Circuit Judge Craig Carter processed a total of 28 criminal cases and seven civil cases during the Nov. 8 session of Ozark County Law Day. The criminal case updates are listed below. 

 

Cases that reached 

disposition

Michael Linn Cox pleaded guilty to domestic assault and was sentenced to a 120-day institutional treatment program in the Missouri Department of Corrections pursuant to a plea agreement with the state. He has a five-year prison back-up sentence. As part of the agreement, a charge of burglary and a charge of rape were dismissed. 

Michael Shaun Evans pleaded guilty to possession of any controlled substance other than 35 grams or less of marijuana and was given a suspended imposition of sentence and placed on supervised probation for four years. 

Christopher Patrick Thorne pleaded guilty to three counts of arson. He was sentenced to seven years in the Missouri Department of Corrections, but the execution of the sentences was suspended. He was ordered to be released to Victory Mission on Nov. 9. (See related story this page.)

Jami Lynn Vance pleaded guilty to burglary as a stand-up plea, which means he entered the plea without a plea agreement with the prosecutor. A sentencing advisory resort was ordered. A sentencing hearing is scheduled for Jan. 3, 2018. 

 

Probation and 

payment hearings

Jessica Gail Hathcock, who pleaded guilty to possession of any controlled substance other than 35 grams or less of marijuana, appeared for a probation-violation hearing. She completed a 10-day shock jail sentence for violating her probation and is continued on probation.

Anthony L. Martin, who pleaded guilty to resisting and interfering with an arrest for a felony and possession of any controlled substance other than 35 grams or less than marijuana in May 2016, had a probation-violation hearing. He had completed a 10-day shock jail sentence for violating his probation and is continued on probation. 

Blake R. Medlin, who pleaded guilty to driving while intoxicated in March 2016, appeared for a probation-violation hearing. He admitted violating his probation. The case was continued to Dec. 6. 

Kelley Mitchell Risley, who pleaded guilty to possession of any controlled substance other than 35 grams or less of marijuana, appeared for a probation-violation hearing. The hearing was continued to Dec. 6. 

Archie Vncent, who pleaded guilty to non-support of a child with total arrears in excess of 12 monthly payments due under an order of child support, appeared for a probation-violation hearing. It was continued to Dec. 6. 

Jerry Allen Johnson, who pleaded guilty to two counts of stealing a motor vehicle in October 2014, appeared for a probation-violation hearing. The state filed a motion to discharge the defendant after court costs are paid.

Jeffrey William Kaufman, charged with driving while intoxicated as a persistent offender, had his plea hearing or trial setting continued. 

John Wesley McCullough, charged with possession of any controlled substance other than 35 grams or less of marijuana, had his plea hearing or trial setting continued. 

Blake R. Medlin, charged with driving while intoxicated with alcohol as a persistent offender, had his sentencing hearing continued. 

Ryan S. Padgett, charged with two counts of distributing, delivering, manufacturing or attempting to possess with intent to distribute, deliver or manufacture, was arraigned. A plea hearing or trial setting is scheduled. 

Amy L. Smith, charged with two counts of possession of any controlled substance other than 35 grams or less of marijuana, was arraigned. A plea hearing or trial setting is scheduled. 

Albert Lee Stanford, charged with possession of marijuana, possession of a controlled substance, second-degree assault by operating a vehicle while intoxicated resulting in an injury, unlawful use of drug paraphernalia, operating a vehicle on a highway without a valid license, failure to display plates on a vehicle, owner/operator of a motor vehicle without maintaining financial responsibility (motor vehicle required to be registered) and two counts of failure to wear a properly adjusted seatbelt, had his plea hearing or trial setting continued. 

Joshua Toscano, charged with burglary, theft/stealing of property or services valued between $500 and $25,000, purchase or attempt to purchase liquor by a minor, assault of a law enforcement officer and armed criminal action, appeared for a case review. A trial setting was scheduled. He is required to be supervised pretrial by Court Probationary Services.

Brian M. Moray, charged with non-support of a child with total arrears in excess of 12 monthly payments due under a child support order, had his trial setting continued. It is the final continuance. 

 

Trials scheduled

Michele McFarlin, charged with non-support of a child with total arrears in excess of 12 monthly payments due under a child support order, is now scheduled for a jury trial on May 1, 2018. A pre-trial conference will be held April 4. 

Brandon J. Patterson, charged with animal abuse by torturing an animal while alive, manufacturing 35 grams or less of marijuana, possession of 11 to 35 grams of marijuana, is now scheduled for a jury trial May 3-4, 2018. A pre-trial conference will be held April 4.

 

Other cases

Robert Peat Jr., charged with first-degree murder, abuse or neglect of a child resulting in death, second-degree murder, tampering with physical evidence in a felony prosecution and abandonment of a corpse, appeared for a motion hearing on a previously filed motion for a change of venue and change of judge. The motions were sustained. A judicial transfer request was emailed to the Supreme Court for judicial appointment.
