Judge Carter hears 26 criminal cases during Dec. 9 Law Day

Circuit Judge Craig Carter processed a total of 26 criminal cases during the Dec. 9 session of Ozark County Law Day. Updates on the cases, if available, are listed below. 

 

Plea, sentencing

Floyd L. Lamb III pleaded guilty to possession of a controlled substance. He was given a suspended imposition of sentence and was placed on supervised probation for a term of five years. 

Toby Hudson pleaded guilty to an amended charge of receiving stolen property. He was sentenced to a 120-day institutional drug treatment program in the Missouri Department of Corrections. He has a backup sentence of five years in prison. Hudson was originally charged with burglary, two counts of stealing a firearm and stealing $750. Ozark County Prosecuting Attorney John Garrabrant filed the amended complaint, changing the charge to the lesser offense of receiving stolen property. 

 

Probation matters

Angela Brake, who pleaded guilty to second-degree assault in March 2019, appeared for a probation-violation hearing. Online records indicate that she entered into the Ozark County Drug Court program later that day. 

Christopher Scott Davis, who pleaded guilty to possession of a controlled substance in April 2019, appeared for a probation-violation hearing. It was held, and another probation-violation hearing was scheduled for 1:30 p.m. Wednesday, Dec. 23. He was also arraigned on a new case in which he’s charged with aiding the escape of another prisoner from confinement for a felony. He will appear in that case the same day.

Anthony Fletcher, who pleaded guilty to receiving stolen property in March, appeared for a case review. He was continued on probation. 

Archie Vincent, who pleaded guilty to non-support of a child with total arrears in excess of 12 monthly payments due under a child support order, did not appear for his scheduled probation violation hearing. A show-cause hearing was scheduled for 9 a.m. Wednesday, Jan. 6, 2021.

Tanner Wilburn Jennings, charged in two separate cases with purchase or attempt to purchase liquor by a minor and driving while intoxicated resulting in serious physical injury and leaving the scene of an accident with serious physical injury, appeared for a plea hearing or trial setting. It was continued to 9 a.m. Jan. 6, 2021

Nicholas J. Keeling, charged with possession of a controlled substance, was arraigned. A plea hearing or trial setting is scheduled for 9 a.m. Jan. 6, 2021. 

 

Scheduled or continued to Feb. 3, 2021

Timothy Sprague, charged with unlawful possession of a firearm, delivery of a controlled substance and domestic assault, appeared for a plea hearing or trial setting. It was continued to 9 a.m. Feb. 3, 2021.

Robert Abbott, charged in three separate cases with tampering with two counts of motor vehicle, two counts of stealing a firearm, two counts of unlawful possession of a firearm and escape from confinement, was arraigned. A plea hearing or trial setting is scheduled for 9 a.m. Feb. 3, 2021. 

Andrea Greer, charged with first-degree burglary, appeared with her attorney for a plea hearing or trial setting. It was continued to 9 a.m. Feb. 3, 2021. 

 

Trial set

Thaddeus A. Humiston, charged with second-degree assault, appeared for a pre-trial conference before his Dec. 29 trial. He signed a written waiver of jury trial. A bench trial will be conducted.

Skyler Ledbetter, who pleaded guilty to making a terroristic threat in October 2019, appeared for a probation-violation hearing. Information and updates on the case are no longer visible to the public.

Dennis Millem, charged with possession of a controlled substance, was scheduled to be arraigned. Information and updates on the case are no longer visible to the public.

Phyllip Benjamin Mitchell, charged in two separate cases with possession of a controlled substance and possession of marijuana, was scheduled to appear for a plea hearing or trial setting.  Information and updates on the case are no longer visible to the public.

Michael Renne, charged with possession of a controlled substance, was scheduled to be arraigned.  Information and updates on the case are no longer visible to the public.

Makayla Souder, who pleaded by Alford plea to unlawful use of a loaded weapon while intoxicated, was scheduled to appear for a final disposition/sentencing hearing. (An Alford plea means a defendant does not admit the crime and asserts their innocence but believes the evidence the prosecution holds would likely persuade a jury to convict them.)  Information and updates on the case are no longer visible to the public.

Austin Craig Williams, who pleaded guilty to possession of a controlled substance and unlawful use of a weapon for possessing a weapon and a felony-level controlled substance at the same time in October 2019, was scheduled for a hearing. Dalton R. Woodward, charged with burglary, stealing $750 or more and tampering with a motor vehicle, was scheduled to appear for a plea hearing or trial setting.  Information and updates on the case are no longer visible to the public.
