Carter hears seven civil cases and 15 criminal cases during Sept. 6 Law Day
Circuit Judge Craig Carter processed a total of 22 cases during the Sept. 6 session of Ozark County Law Day. Updates on the criminal cases are listed here:
Plea, sentencing
Tiger Wood Tolliver pleaded guilty to possession of a controlled substance and was given a suspended imposition of sentence and placed on supervised probation for a term of five years. He is also ordered to submit to twice-per-month drug testing and a substance-abuse evaluation. He was ordered to pay $300 to the county law enforcement restitution fund and comply with all other standard terms of probation.
Warrant issued
Michael Scott Strickland, who pleaded guilty by Alford plea to burglary in May 2018, failed to appear for a probation conditions review hearing. A capias warrant was issued. The hearing was continued to 1:30 p.m. Sept. 20.
Inpatient treatment
Dewayne R. Allen, who pleaded guilty to unlawful possession of a firearm (dangerous felon) in November 2021, appeared for a probation violation hearing. The judge is allowing Allen to be released to an inpatient treatment facility, Turning Leaf, in West Plains on Sept. 14. Upon release, he is to report to the Missouri Department of Probation and Parole.
Change of judge
Sarah C. Adams, charged with domestic assault (causing serious physical injuries), two counts of abuse or neglect of a child, unlawful use of a weapon (exhibiting), three counts of endangering the welfare of a child, domestic assault and kidnapping, filed a motion for a change of judge away from Judge Carter. The motion was sustained, and the circuit clerk will notify the Office of State Courts Administrator (OSCA) for judicial reassignment.
Continued on probation
Floyd L. Lamb III, who pleaded guilty to possession of a controlled substance in February 2020, appeared for a probation conditions hearing. He has had no issues while on probation. He was continued on probation.
Scheduled or continued to Sept. 20
Sondra F. Clark, charged with second-degree murder, appeared for a show cause hearing with her attorney. She is scheduled to return to court at 9 a.m. Sept. 20.
Aaron Bradley Perry, charged with tampering with a victim in a felony prosecution in one case and burglary, child kidnapping, two counts of first-degree kidnapping, endangering the welfare of a child, third-degree domestic assault and fourth degree domestic assault in a second case, appeared with his attorney. A motion to suppress was held. Counsel was ordered to forward suggestions by Sept. 15. The motion was taken under advisement. He is scheduled to return to court at 1:30 p.m. Sept. 20.
Aaron Bradley Perry, charged with attempting domestic assault and violation of an order of protection for an adult, was arraigned. A plea hearing or trial setting was continued to 1:30 p.m. Sept. 20.
Scheduled or continued to Oct. 4
Herbert Palmer was arraigned on a charge of failure to appear for a felony. He is scheduled to return to court for a plea hearing or trial setting 9 a.m. Oct. 4.
Scheduled or continued to Oct. 18
Brian Dunaway, who pleaded guilty to voluntary manslaughter in June 2022, appeared for a probation violation hearing. The prosecutor said the state would be filing a motion asking to revoke Dunaway’s probation and send him to prison for the violation. The probation violation hearing was continued to 1:30 p.m. Oct. 18.
Jerry Joseph Chiasson, charged with stealing a motor vehicle, appeared with his attorney. A plea hearing or trial setting is scheduled for 1:30 p.m., and the victim in the case is set to appear at that time.
Michael L. Jones, charged with stealing a motor vehicle and possession of a controlled substance, appeared with his attorney. A plea hearing or trial setting is scheduled for 1:30 p.m. Oct. 18. His bond conditions were amended to allow substance testing once every two weeks.
Scheduled or continued to Nov. 8
Michael Turner, who pleaded guilty to possession of a controlled substance in August 2022, appeared. He has new misdemeanor charges filed against him. A probation conditions review hearing is scheduled for 9 a.m. Nov. 8.
Scheduled or continued to Dec. 6
Kimberly Hemphill, charged with possession of a controlled substance, appeared for a plea hearing or trial setting. It was continued to 9 a.m. Dec. 6.
