Three sent to prison during Law Day

Circuit Judge Craig Carter sent three men to prison during the Sept. 7 session of Ozark County Law Day. Here are the details in those cases and other criminal cases Carter heard that day.

 

Sent to prison

Chad E. Brandon pleaded guilty to possession of a controlled substance and was sentenced to prison for three years. 

Justin Patrick Bell, who pleaded guilty to unlawful possession of a firearm in September 2020, appeared for a probation violation. He admitted to violating his probation. His probation was suspended, and his back up 4-year prison sentence was enacted. 

Daniel A. Reeb pleaded guilty to forgery and was sentenced to prison for three years.  

 

Plea hearing

Rhonda Sprague pleaded guilty to two counts of assault as part of a plea agreement. All other charges filed against her were dismissed. A sentencing advisory report was ordered. It was agreed that the sentence would be capped at five years in prison, with the execution suspended and five years probation. She was allowed to be released with supervision from Court Probationary Services. 

 

Trials scheduled

Patrick K. Lee, charged with burglary, domestic assault and robbery, had a March 29-30, 2023 jury trial scheduled. A pre-trial hearing will be held Feb. 22. 

Kayla Marie Oliver, charged with possession of a controlled substance, had a March 3, 2023, jury trial set. A pre-trial conference is scheduled for Feb. 8. A plea agreement was offered in which Oliver would get probation and a suspended imposition of sentence in exchange for pleading guilty. She refused the offer. 

Aaron Lee Davis, charged with burglary, five counts of stealing a firearm and stealing $750 or more, appeared with his attorney Rickey Farrow. A jury trial was set for Feb. 1-2, 2023. A pre-trial conference will be held Jan. 4. He is allowed to be released with supervision by Court Probationary Services.

Brian Dunaway, charged with second-degree murder, unlawful use of a weapon, possession of a controlled substance, two counts of endangering the welfare of a child and two counts of armed criminal action, had a jury trial set Nov. 1-3. A pretrial conference will be held Oct. 5. 

Dustin Allen Brown, charged with domestic assault and endangering the welfare of a child, had a jury trial set for Nov. 29- Dec. 1. A pre-trial conference will be held Oct. 19. 

 

Shock jail sentence

Angela D. Brake, who pleaded guilty to second-degree assault in March 2019, appeared for a probation violation hearing where she admitted to using marijuana. She was ordered to serve a 7-day shock jail sentence. 

Toby C. Hudson, who pleaded guilty to receiving stolen property in December 2020, appeared for a probation violation hearing. He’d completed a 7-day shock sentence for the violation prior to court. He was continued on probation.

Brandon J. Adams, who pleaded guilty to domestic assault by Alford plea in March 2022, appeared for a probation violation hearing. He had already completed the 7-day shock jail sentence for the violation. 

Kaylee Isaac, who pleaded guilty to possession of a controlled substance in January 2022, appeared for a probation violation hearing where she admitted to using meth and marijuana. She was remanded to custody and is scheduled to appear Sept. 21. 

Eric Vandiver, charged with delivery of a controlled substance, appeared with his attorney Lauren Kate Welborn. He tested positive for amphetamines. He ordered to serve a 7-day shock jail sentence and return to court for a plea hearing or trial setting Oct. 19. 

 

Change of venue

Daniel E. Johnson, whose charge information wasn’t available, has had his case transferred to Wright County on a change of venue motion. A jury trial and pre-trial conference will be held there. 

 

Case complete

Stephanie Sharp, who pleaded guilty to stealing/theft (value of property or services is less than $500), had a hearing in which the court reviewed the case and found that the probation was expired. The case was marked complete, and a $400 bond was refunded to Sharp. 

Albert Lee Stanford, who pleaded guilty to assault in the second-degree by operating a vehicle while intoxicated resulting in an injury in December 2017, appeared for a hearing. He had paid restitution in full. The case was marked complete.

 

Continued on probation

James Alvin Nelson, who pleaded guilty to two counts of possession of a controlled substance in March 2020, appeared for a probation violation hearing. He was continued on probation. 

Sarah Sue Prewett, who pleaded guilty to possession of a controlled substance, appeared for a probation violation hearing. She told the judge that she’s enrolled in the drug court program and was continued on probation. 

Nicholas J. Keeling, who pleaded guilty to possession of a controlled substance in May 2021, appeared for a probation violation hearing. He was ordered to report once every three months and submit to random urinalysis for substance use when asked. He was continued on probation. 

 

Scheduled for Sept. 21

Brian K. Moray, who pleaded guilty to non-support of a child with total arrears in excess of 12 monthly payments due under a child support order in October 2018, appeared with his attorney Patrick James Paradise. The judge allowed a bond to be set in the case at $5,000 cash only. Moray had been in custody since Aug. 10. A probation violation hearing is scheduled. 

Levi C. Hambelton, charged with domestic assault, is scheduled for a plea hearing or trial setting. 

Alyssa Brooke Collins, charged with domestic assault, armed criminal action and unlawful use of a weapon (exhibiting), appeared with her attorney Patrick James Paradise. A plea hearing or trial setting is scheduled. 

 

 

Scheduled for Oct. 5

Sarah C. Adams, charged with two counts of domestic assault, three counts of abuse or neglect of a child, unlawful use of a weapon, three counts of endangering the welfare of a child and kidnapping, appeared for a hearing. The condition that she wear an ankle monitor was removed from her pre-trial release conditions. 

 

Scheduled for Oct. 19

Samantha Rodak-Triboulet, who pleaded guilty to burglary and stealing $750 in January 2019, appeared for a hearing with her attorney Lauren Kate Welborn. The judge ordered that her probation remain suspended. A probation violation hearing is scheduled. 

Zack L. Burris, who pleaded guilty to domestic assault in November 2019, appeared with his attorney Patrick James Paradise. The judge allowed his release from custody, where he’s been held since Aug. 8, with supervision by Court Probationary Services. He’s scheduled to return for a probation violation hearing.

William Timothy Chamberlain, charged with non-support of a child with total arrears in excess of 12 monthly payments due under a child support order, was arraigned. He’s scheduled to return for a plea hearing or trial setting.  

Blake Dalton White, whose charge information wasn’t available, appeared with his attorney Lauren Kate Welborn. A pre-trial release hearing was held. He is now able to be released with supervision by Court Probationary Services on house arrest with a GPS-monitoring ankle bracelet and agreed-upon home plan. He’s scheduled to return for a plea hearing or trial setting. 

Noel D. Cole, charged with assault of a special victim, endangering the welfare of a child, resisting arrest by fleeing, two counts of resisting arrest for a felony, harassment and trespassing, was scheduled to appear for a hearing. The public defender filed a motion to withdraw from the case, and it was sustained and defense attorney Benjamin Lane Arnold filed in the case to represent him. A pre-trial conference is scheduled prior to Cole’s Nov. 14 jury trial. 

Tiffany Bauer, charged with violating a condition of lifetime supervision, was arraigned. She posted a $5,000 bond. A plea hearing or trial setting is scheduled. 

Michelle Wilcox, charged with possession of a controlled substance, was scheduled for a plea hearing or trial setting. It was continued to allow her time to hire an attorney. 

Jeffrey Pine, charged with two counts of domestic assault and tampering with a victim in a felony prosecution, appeared. He’d previously been arraigned. The defendant was ordered to correspond with the state regarding GPS supervision. He’s ordered to return to court for a plea hearing or trial setting. 

Mark Kenneth Lowry, charged with two counts of domestic assault, sexual abuse, kidnapping and robbery, appeared with his attorney Patrick James Paradise. A motion to amend his pre-trial release conditions was overruled without prejudice. He’s scheduled to return to court for a plea hearing or trial setting. 

Danny Batesel, charged with domestic assault, armed criminal action, burglary, resisting or interfering with an arrest and violation of an order of protection for an adult, appeared for a plea hearing or trial setting. His pre-trial release from another case was allowed in this case as well. He’s ordered to return to court for a plea hearing or trial setting. 

 

Scheduled for Nov. 9

Nicole Smith, charged with stealing and fraudulent use of a debit or credit card, appeared for a plea hearing or trial setting. It was continued. 

James M. Ruark, charged with delivery of a controlled substance and delivery of a controlled substance at a jail, appeared with his attorney Christopher Swatosh. He’s scheduled to return for a plea hearing or trial setting. 

Dakota Maynard, charged with promoting child pornography to a minor and possession of child pornography, is scheduled for a plea hearing or trial setting. 

Jason Marsh, charged with assault, was arraigned and filed a motion for a change of venue through his attorney George Chrysler Fisher Jr. Another hearing was scheduled. 

 

Scheduled for Nov. 23

Michael S. Burkeen, charged with assault, armed criminal action, unlawful use of a weapon (shooting into a building) and receiving stolen property in one case and burglary and two counts of stealing a firearm in another, appeared for a hearing with his attorney Lauren Kate Welborn. Burkeen told the judge that his present Arkansas charges predate the Ozark County case. He was allowed to be released to Mountain Moving Ministries program. A setting is scheduled. 

Matthew W. Woolin, charged with vehicle hijacking and domestic assault, appeared with his attorney Richard Dale Bender. A motion to amend pretrial release conditions was overruled. He’s scheduled to return to court.

Hailie J. Spears, who pleaded guilty to possession of a controlled substance in December 2021, appeared for a probation violation hearing. She submitted an application for public defender services, which was denied; however, the judge appointed the public defender in the case, as he found that her due process rights under Missouri Revised Statute 559.036 need to be protected. She’s scheduled to reappear for the probation violation hearing. 

Matthew B. Woolin, charged with sexual exploitation of a minor child, two counts of domestic assault, armed criminal action, four counts of abuse or neglect of a child and two counts of endangering the welfare of a child, appeared with his attorney Richard Dale Bender. A motion to amend his pre-trial release was overruled. He’s scheduled to return for a plea hearing or trial setting. 

 

Scheduled for Dec. 21

Robert Stewart Morris, who pleaded guilty to assault in June 2020, appeared for a probation conditions review hearing. He had paid $400 in the case since June. He was scheduled to return for another review hearing.
